impact with another project and that would be the case with the masonic -- project. the planning department itself sis in their brief the cumulative impact is the streets and their vicinity affected by the project. masonic is the major north-south thoroughfare and fell and oak are the major east-west thoroughfares. masonic has 32,000 motor vehicles a day it's a few blocks from baker street. in fact, they were going to remove a bus stop on central, which is only one block from masonic. the masonic project would remove all street parking on both sides of masonic for over half a mile including through fell street around 171 parking spaces reduce travel lanes on masonic during morning and evening rush hour just as the fell and oak would remove -- on rush hour and reduce lanes on baker which -- between fell and oak. many motorists basically, and pedestrians, turn north on masonic from fell and oak. many who are proceeding southbound on masonic turn left on oak. so the masonic project will have environmental impact on the same neighborhood which will be compounded by this particular pr

and reduced visibility on such busy corridors. the masonic avenue bicycle project is only three blocks away yet the city claims they do not overlap so this should not be studied. the masonic plan will remove 167 parking spaces and all commute lanes. there is a target store planned on masonic and geary which will add to the traffic in the area. removing the commuter lane, adding raised plantares throughout the buffer strip and removing over 90 parking spaces constitutes an unusual circumstance of the project. proposed parking mitigation peat adequate. this is a highly dense touristy area and a main east-west corridor. there's no one else -- impact on neighboring streets such as hayes paige and haight street. part six -- is a priority street. finally, because the fell and oak project is obviously part of the greater plan to create bike lanes ceqa analysis should be done in connection with the eir for the san francisco bicycle plan project not piecemealed from the larger project that is ceqa rule. determination -- the determination made no effort to address the fell oak project in the larger c

a constitution of everybody there was -- would you have the amendments to the constitution if mason was more cynical than adams? would you have the declaration of independence if jefferson was a cynic rather than someone -- [inaudible] would you have a constitution of medicine didn't care? all the nick of that stuff, you know? i have come to the point and i tell my law clerks, that i have been in the city doing these jobs now for half of my natural life. the only reasons to do them are the ideal things. it's always the things you believe in, the constitution of this country. i know that's not what to say in washington d.c. and you're supposed to say there's some angle, some methodology, this originalism, textualism. there are all these useless peripheral debates other than just doing our job as we can in trying to live up to our respective oaths, to make it all work. this is what we are talking about. in your book, that is what you are saying. you are saying we have the text but you also also have overhear this unwritten part. with all these things are happening over here to make it all work

. the traders joe at masonic was, but i think they are not any longer. i am not sure what they are doing. they may be redeeming in-store. you can redeem in-store, meaning that you take it back and some stores kind of do that quietly. in other words, they don't put out a big sign and you can quietly redeem in-store and avoid the $100. it's a relatively small number in the city. i'm not sure if it's been high enough is to make the stores not do it. they just haven't chosen that option at this point. >> so for those that have done it, we don't have anything to address the waste that they are generated, it's basically accounted for when they elect to pay the fee? >> it's just basically spread out amongst the rest of the city essentially. >> okay. so it seems to me that it is going to require a combination of ideas. i am inclined to agree with commissioner dooley. i don't like being heavy-handed or anything like that, but the environment and the waste is a mandatory matter that has to be addressed because it happens to be reality. so it seems to me that certainly existing facilities n

since 1970 and used to live in jefferson and mason and walked down to the agency 'em cafe before it was a pier 39 and sat in the lumbar i can't remember the regard and i recognize how much this city has changed since then and it has made it one of the most remarkable water fronts and it certainly was not back then and i believe the street artists add a tremendous amount of vitality to this city and i'm also happy to be asked and answered question and is we get a dozen of them each day and when i'm across the street i love "where is market street," where is the ferry building," i can't tell you how many times i have been asked that question and i'm alms happy to point them in the right direction. we make our own crafts and think that we represent something unique and different and something special to the tourists that visit this time and the people that live and work here and i would say that 70% of my customers live and work here in san francisco and so with that, i conclude and thank you for your consideration. >> debra king and then hal fan. rp. >> good afternoon commiss
